These Terms of Use ("Terms") govern your access to and use of the PassUS.AI mobile application ("App") operated by METAPHORIA INC ("we," "us," or "our"). By using the App, you agree to these Terms.

1. Educational Purpose Only

PassUS.AI is designed solely as a study aid and educational practice tool to help users prepare for the U.S. naturalization civics test. Specifically:

• The App provides practice questions based on publicly available USCIS study materials.
• The AI mock interview simulates a practice environment — it does not replicate, replace, or predict actual USCIS interview procedures or outcomes.
• The AI tutor provides educational explanations — it does not provide legal, immigration, or professional advice of any kind.
• No feature of this App should be interpreted as legal counsel or a substitute for consulting a licensed immigration attorney.

2. AI Disclaimer & Limitations

• No reliance: You should not rely solely on AI-generated content for any decision related to your immigration application, interview preparation, or legal matters.
• Verify with official sources: Always verify information with USCIS.gov or a qualified immigration attorney.
• AI is not a government official: The AI "officer" characters are fictional simulations for practice purposes. Their evaluations, scores, and feedback do not reflect actual USCIS standards or decisions.
• No guarantee of results: Using this App does not guarantee that you will pass the USCIS naturalization test or be approved for citizenship.
• Content may change: U.S. civics test questions, government officials, and laws change over time. While we strive to keep content current, we cannot guarantee real-time accuracy.

3. Compliance with U.S. Immigration Law

• All civics questions and answers are derived from publicly available USCIS study materials (the official 100 civics questions).
• The App does not assist with, facilitate, or encourage any violation of U.S. immigration laws or regulations.
• The App does not collect, process, or transmit any immigration documents, case numbers, A-Numbers, or application data.
• The App does not represent itself as USCIS, a government service, or an immigration legal service.
• The App does not provide answers during an actual USCIS interview or any form of cheating assistance.
• Users are prohibited from using this App during any official government proceeding.

4. Unauthorized Practice of Law Disclaimer

METAPHORIA INC is a technology company, not a law firm. No attorney-client relationship, fiduciary relationship, or professional advisory relationship is created by your use of the App. If you need legal advice regarding immigration, naturalization, or any legal matter, consult a licensed immigration attorney.

5. User Responsibilities

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App.
• You are solely responsible for your decisions, actions, and outcomes related to your immigration process.
• Do not input sensitive personal information into the AI chat, including but not limited to: Social Security Numbers, A-Numbers, passport numbers, financial information, or immigration case details.
• You agree not to misuse the App for any unlawful purpose, including fraud, harassment, or interference with government processes.

6. Account & Credits

• New users receive a one-time welcome bonus of credits for trial use.
• Additional credits may be purchased via in-app purchase through Apple's App Store.
• Credits are non-transferable and have no cash value.
• We reserve the right to modify credit pricing, packages, or consumption rates at any time.

7. In-App Purchases & Refunds

• All in-app purchases are processed by Apple through the App Store.
• Purchases are subject to Apple's Terms and Conditions.
• For refund requests, please contact Apple Support directly through your purchase history.
• We do not process payments directly and do not have access to your payment information.

8. Intellectual Property

• The App's design, code, AI prompts, and original content are the property of METAPHORIA INC.
• USCIS civics questions are public domain U.S. government materials and are not claimed as our intellectual property.
• You may not copy, redistribute, reverse-engineer, or create derivative works from the App without permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
• WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WE ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS OR USD $50, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless METAPHORIA INC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the App or violation of these Terms.

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
• Any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA) in New Castle County, Delaware.
• You waive any right to a jury trial or to participate in a class action lawsuit.
• If arbitration is found unenforceable, disputes shall be resolved exclusively in the state or federal courts of Delaware.

12. Termination

We may suspend or terminate your access at any time, with or without cause, including for suspected abuse, fraud, or violation of these Terms. Upon termination, your right to use the App ceases immediately. Unused credits are forfeited upon termination for cause.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
